According to an announcement by the Ministry of Labor, from 2026 a new framework for labor law inspections by the Labor Inspectorate (SEPE) and the Social Security Institution (EFKA) will be implemented, with an emphasis on electronic inspections and automated data cross-checks.
In the new system, fines for labor law violations are recorded electronically and in real time, while on-site inspections are gradually reduced and replaced by electronic data cross-checks. At the same time, cross-checks between declarations submitted through ERGANI II and the Analytical Periodic Declarations (APD) are introduced.
What Is Checked Through Electronic Data Cross-Checks
The inspections cover, among others:

inconsistencies in Digital Work Card clock-ins,
-
violations of working time regulations, including overtime and rest periods,
-
exceeding the statutory weekly working time (on average 48 hours per week),
-
discrepancies between declared and paid remuneration,
-
repeated overtime without the granting of a rest day.
Employer Classification and Compliance Procedure
Employers are classified into categories of non-compliance, with particular focus on repeat offenders. Initially, a compliance notice is issued. If the violation is repeated, an inspection is carried out and the applicable fines are imposed, depending on the case.
The notification of compliance recommendations is carried out through the SEPEnet platform, via the contact email address registered by the company.
